Within the framework of the regulation of Law 1042, the Cybercrime Law (the "Law"), which entered into force on October 30, 2020, the Nicaraguan Institute of Telecommunications and Postal Services (TELCOR) published on Friday, January 29, 2021, the Administrative Agreement 001-2021 of Regulations for the Preservation of Data and Information (the "Regulation").
This Regulation is issued in order to establish the guidelines and parameters that will govern the preservation of data and information generated within the framework of the provision of telecommunications services. The above, related to the processes of investigation and prosecution of cybercrimes regulated by the Law.
The Regulation is of general application for all telecommunication service operators authorized by TELCOR and requires the collection of information and data generated from communications made by its users in order to, among others:
The above, for communications made by users related to, among others, fixed and mobile telephony service, internet access, Internet e-mail, and Internet telephony (VoIP).
The period of preservation of the information required will be for at least 12 months since the communication was made. Otherwise, the Operators will be subject to the corresponding sanctions according to the provisions of the law on the matter.
